General conditions of sale

These General Conditions of Sale are concluded between, on the one hand, Schino Care - LAO Care, SAS with capital of €26,881 registered with the Strasbourg Trade and Companies Register under number 884 538 729, having its registered office at 10, rue des cerisiers, 67170 Brumath, and on the other hand any person having made a purchase on the website www.lao-care.com .

Any purchase on the website www.lao-care.com automatically entails acceptance of all of these conditions, which the Customer acknowledges having read prior to placing an order.


Article 1 - Fields of application

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by the company SAS SCHINO Care (LAO), (“the Seller”) with any person having made a purchase on the site www.lao-care.com , hereinafter referred to as “the Customer”.

They specify in particular the conditions of ordering, payment, delivery and management of any returns of Products ordered by Customers.

The choice and purchase of a Product is the sole responsibility of the Customer.

These General Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.

These General Conditions of Sale are accessible at any time on the website www.lao-care.com and will prevail, where applicable, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

In accordance with the Data Protection Act of 6 January 1978, reinforced and supplemented by the GDPR (General Data Protection Regulation) which came into force on 25 May 2018, the Client has, at any time, a right of access, rectification, opposition, erasure and portability of all of his personal data by writing, by post and providing proof of identity, to the Schino Care Company, at 10, rue des cerisiers 67170 Brumath.

The Products presented on the website www.lao-care.com are offered for sale in the following territories: France, Europe, worldwide.

In the event of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and French overseas departments and territories, the price will be calculated excluding taxes automatically on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. These will be the sole responsibility of the Customer.

 

Article 2 - Capacity of the buyer

The Customer who purchases on the site declares to be legally capable of committing to these general conditions of sale.

Article 3 - Sale price

All prices displayed on the website are inclusive of all taxes and are quoted in euros. Schino Care reserves the right to change its prices without prior notice, and the prices applied to the Customer correspond to those displayed on the website at the time of the order. The goods remain the full property of Schino Care SAS until receipt of the total amount due from the Customer.

In accordance with the European Omnibus Directive, for any promotion displayed, the lowest price practiced over the previous 30 days will be clearly indicated next to the promotional price.

Product offers are subject to availability, as specified when the order is placed.

The sales prices do not include processing, shipping, transport and delivery costs, which are charged in addition, under the conditions indicated on the website www.lao-care.com and calculated prior to placing the order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.

Article 4 - Presentation of articles

Schino Care strives to present and describe its Products as accurately and precisely as possible.

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the site www.lao-care.com .

The Customer is required to refer to the description of each Product in order to understand its properties and particularities.

The photographs and graphics presented on the website www.lao-care.com are not contractual and cannot engage the responsibility of the Seller.


Article 5 - Orders

The order is validated once payment has been accepted by Schino Care. Schino Care reserves the right to refuse an order if the Customer already has a dispute with the Seller or if Schino Care believes that the Customer poses a risk of defaulting on payment. Schino Care then reserves the right to request additional information from its Customer if it deems it necessary, such as an identity document or proof of address.

If the Customer does not respond within 5 days of placing the order, the order and payment will be canceled. Schino Care undertakes to fulfill orders received, subject to availability.

Contractual information is presented in French and is subject to confirmation at the latest at the time of validation of the order by the Customer.

Product offers are valid as long as they are visible on the site, within the limits of available stocks.

The Customer has the opportunity to check the details of their order, its total price and to correct any errors before confirming their acceptance (Article 1127-2 of the Civil Code). This validation implies acceptance of all of these General Terms and Conditions of Sale and constitutes proof of the sales contract.

It is therefore the Customer's responsibility to check the accuracy of the order and to immediately report any errors.

Any order placed on the website www.lao-care.com constitutes the formation of a contract concluded remotely between the Customer and the Seller.

The Customer can follow the progress of their order on the website www.lao-care.com.

The Seller does not intend to sell the Products on the website www.lao-care.com to professionals, but only to consumers or non-professionals, for their personal needs.

The Seller therefore reserves the right to refuse orders for the same Product in large quantities.

In the event of cancellation of the order by the Customer after its acceptance by the Seller less than 3 (three) days at least before the date scheduled for the supply of the Products ordered, for any reason whatsoever other than the exercise of the right of withdrawal or force majeure, a sum corresponding to 20 (twenty)% of the total amount of the purchase will be acquired by the Seller and invoiced to the Customer, as damages, in compensation for the loss thus suffered.


Article 6 - Payment conditions

The price is payable in cash, in full on the day the order is placed by the Customer, by secure payment, according to the following terms:

- by bank cards: Visa, MasterCard, American Express, Apple Pay

Payment data is exchanged in encrypted mode using the Shopify Payments tool, or the Paypal tool, depending on the customer's choice.

The Seller shall not be required to deliver the Products ordered by the Customer if the latter does not pay the price in full under the conditions indicated above.

Payments made by the Customer will only be considered final after actual collection of the amounts due by the Seller.

Late payment will result in the immediate payment of all sums owed by the Customer, without prejudice to any other action that the Seller may be entitled to take against the Customer in this regard.

Furthermore, the Seller reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of current orders placed by the Customer.

No additional costs, greater than the costs incurred by the Seller for the use of a means of payment, may be charged to the Customer.


Article 7 - Secure payment - Protection of banking transactions

Schino Care entrusts the security of its transactions to the provider Shopify Payments, or to Paypal, depending on the Customer's choice.

Payment is secure thanks to the online payment system of our partners Shopify and Paypal. Banking data only circulates over the Internet in encrypted form, meaning it is coded in such a way as to make it completely illegible and is therefore never stored or accessed by Schino Care.

Article 8 - Delivery in Metropolitan France

Our shipping times are as follows:

- For any order placed from Monday to Friday, the order will be shipped the next day.

- For any order placed from Friday after 1 p.m. to Sunday evening, the order will be shipped the following Monday.

- For any order placed on public holidays, the order will be shipped the following working day.

Delivery is constituted by the transfer to the Customer of physical possession or control of the Product.

Except in special cases or in the event of unavailability of one or more Products, the Products ordered will be delivered in one go.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the timeframes specified above. However, these timeframes are provided for information purposes only.

However, if the ordered Products have not been delivered within thirty (15) days after the indicative delivery date, for any reason other than force majeure or the actions of the Customer, the sale may be terminated at the written request of the Customer under the conditions provided for in Articles L 216-2 L 216-3 L241-4 of the Consumer Code. The sums paid by the Client will then be returned to him no later than fourteen days following the date of termination of the contract, excluding any compensation or withholding.

Deliveries are made by an independent carrier, to the address indicated by the Customer when ordering and which the carrier can easily access.

When the Customer has himself arranged for a carrier of his own choosing, delivery is deemed to have been made upon delivery of the Products ordered by the Seller to the carrier once he has handed over the Products sold to the carrier who has accepted them without reservation. The Customer therefore acknowledges that it is the carrier's responsibility to carry out delivery and has no right of recourse under warranty against the Seller in the event of failure to deliver the transported goods.

In the event of a specific request from the Customer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the costs related thereto will be subject to specific additional invoicing, based on a quote previously accepted in writing by the Customer.

The Customer is required to check the condition of the delivered products. The Customer has 48 hours from delivery to submit any reservations or complaints regarding non-conformity or apparent defects in the delivered Products (e.g. damaged package already opened, etc.) by email to hello@lao-care.com, with all relevant supporting documents (photos in particular).

After this period and in the absence of compliance with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no claim may be validly accepted by the Seller.

The Seller will refund or replace as soon as possible and at its own expense, the Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in Articles L 217-4 et seq. of the Consumer Code and those provided for in these General Conditions of Sale (see guarantees, in particular).


Article 9 - Transfer of ownership - Transfer of risks

The transfer of ownership of the Seller's Products to the Customer will only take place after full payment of the price by the latter, regardless of the date of delivery of said Products.

Regardless of the date of transfer of ownership of the Products, the transfer of risks of loss and deterioration relating thereto will only take place when the Customer physically takes possession of the Products. The Products therefore travel at the Seller's risk.


Article 10 - Right of withdrawal

In accordance with the legal provisions in force, the Customer has a period of fourteen days from receipt of the Product to exercise his right of withdrawal from the Seller, without having to justify reasons or pay a penalty, for the purpose of exchange or reimbursement, provided that the Products are returned in their original packaging and in perfect condition within 30 days of notification to the Seller of the Customer's decision to withdraw.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be put back on the market in new condition, accompanied by the purchase invoice.

Damaged, soiled, opened or incomplete products are not returned or exchanged.

To exercise the right of withdrawal, the Customer must notify Schino Care (10, rue des cerisiers 67 170 Brumath – hello@lao-care.com) of their decision to withdraw before the expiry of the deadline by means of an unambiguous declaration (for example, letter sent by post or email).

If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be refunded; the return costs will remain the responsibility of the Customer.

The exchange (subject to availability) or refund will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions set out in this article.

In the event of withdrawal by the Customer, Schino Care will reimburse the amount of the order, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a more expensive delivery method than the standard delivery method offered by Schino Care) no later than fourteen days from the day on which Schino Care is informed of its decision to withdraw.

Schino Care may defer reimbursement until receipt of the returned products or until the Customer has provided proof of shipment of the products, whichever comes first.

When the order was accompanied by a gift offered to the Customer under conditions – for example, a gift offered only if a minimum order amount was reached – and the Customer no longer meets the conditions necessary to obtain the gift due to the Customer exercising the right of withdrawal, the gift must be returned to Schino Care with the returned products and Schino Care may defer reimbursement until receipt of the gift or until the Customer has provided proof of shipment of the gift, whichever comes first.

Schino Care will make the refund using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees to a different means and this refund does not incur any costs for the Customer.

The Customer must return or give back the goods to LAO- Schino Care – 10, rue des cerisiers 67 170 Brumath, no later than fourteen days after the Customer has communicated his decision to withdraw.

The Customer will have to bear the direct costs of returning the goods.

Schino Care advises the Customer to choose a shipping method with a tracking number. Without a tracking number, Schino Care will not accept any claims.

The Customer is only liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

 

Article 11 – Promotional codes

Promotional codes apply only to non-discounted base prices. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once per customer account unless otherwise instructed by Schino Care. These codes are non-refundable upon exchange.

 

Article 12 – Intellectual property

All elements present on the website www.lao-care.com, whether visual, textual or audio, are the exclusive property of Schino Care, or the holder of the intellectual property rights concerned, and are as such protected by the intellectual property code and copyright. As such, any reproduction of the Schino Care brand or the website www.lao-care.com, in whole or in part, is strictly prohibited.

You may link to our website, provided you do so in a fair manner and do not damage our reputation or take advantage of our goodwill. However, you must not establish a link in such a way as to suggest any form of association where none exists. Furthermore, you must not establish a link to our site from any website that is not owned by you. We reserve the right to remove links without notice.

 

Article 13 – Limitation of liability

Schino Care shall not be liable to third parties for indirect damages, special damages or incidents resulting from negligence, failure or clumsiness of the Customer, or resulting from improper use by the Customer of one of the products offered for sale on the website www.lao-care.com.

Concerning access to the site, consultation of the latter, the ordering process, payment for delivery and service, the company Schino Care has only an obligation of means.

Schino Care cannot be held liable for any inconvenience or damage inherent to the Internet network, in particular any disruption to the connection or any intrusion of a computer virus.

Furthermore, Schino Care is exempt from any liability for any event deemed to be force majeure within the meaning of the case law of the Court of Cassation. Finally, Schino Care's liability is limited to the amount of the Customer's order.


Article 14 - Seller's Liability - Guarantee

The Products sold on the site www.lao-care.com are subject to the legal guarantee of conformity set out in Articles L.217-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in Articles 1641 et seq. of the Civil Code.

14.1 Legal guarantee of conformity

Article L. 217-4 of the French Consumer Code: The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.

Article L. 217-5 of the Consumer Code: The good is in conformity with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12 of the Consumer Code: Action resulting from lack of conformity is prescribed after two years from delivery of the goods.


14.2 Warranty for defects in the item sold

Article 1641 of the Civil Code: The Seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.

Article 1648 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

When acting under the legal guarantee of conformity, the Client:

- has a period of two years from delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

The Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and may in this case choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article 16 - Anti-waste law (AGEC)

Article 62 of the anti-waste law for the circular economy (AGEC law) adopted on February 10, 2020 provides for the establishment of a unique identifier for all companies or entities subject to the principles of Extended Producer Responsibility (EPR).

Schino Care is registered with ADEME and Citéo under number FR272557_01RRNU and complies with the rules relating to the labeling of cosmetic products and packaging.

Article 17 - Management of personal data

The Client is informed that Schino Care complies with the regulations concerning marketing communication, the law of June 21, 2014 for confidence in the Digital Economy, the Data Protection Act of August 6, 2004 as well as the General Data Protection Regulation (GDPR: European Regulation No. 2016-679).

17.1 Persons responsible for collecting personal data

For Personal Data collected by Schino Care in connection with the sale of products to Customers, the controller of Personal Data is: Schino Care SASU. Schino Care is represented by Ms. Lisa Werlé, its legal representative.

As the controller of the data it collects, Schino Care undertakes to comply with the framework of the legal provisions in force. In particular, it is its responsibility to establish the purposes of its data processing, to provide its prospects and Customers, prior to the collection of their personal data, with complete information on the processing of their personal data and to maintain a record of processing operations that is accurate. Whenever Schino Care processes Personal Data, Schino Care takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which Schino Care processes them.

17.2 Purpose of the data collected

Schino Care may process all or part of the Clients' personal data:

  • to enable the proper execution of product orders placed: connection and Site usage data, invoicing, organization of deliveries to the Customer with the help of external service providers (logistics, carrier), order history, etc.
  • to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for browsing, IP address, password (hashed);
  • to improve navigation on the Site: connection and usage data;
  • to conduct communication campaigns (text messages, email): telephone number, email address.

Schino Care does not market its Customers' personal data, which is therefore only used for the purposes listed above.

17.3 Right of access, rectification and opposition

In accordance with current European regulations, Schino Care Customers have the following rights:

  • right of access (article 15 GDPR) and rectification (article 16 GDPR), updating, completeness of Customer data right to block or erase Customer personal data (article 17 of the GDPR), when they are inaccurate, incomplete, ambiguous, out of date, or whose collection, use, communication or conservation is prohibited;
  • right to withdraw consent at any time (article 13-2c GDPR);
  • right to limit the processing of Customer data (article 18 GDPR);
  • right to object to the processing of Customer data (article 21 GDPR);
  • right to the portability of data that Customers have provided, when this data is subject to automated processing based on their consent or on a contract (article 20 GDPR)
  • right to define the fate of Customer data after their death and to choose to whom Schino Care should communicate (or not) their data to a third party that they have previously designated.

As soon as Schino Care becomes aware of the death of a Client and in the absence of instructions from the Client, Schino Care undertakes to destroy the Client's data, unless their retention proves necessary for evidentiary purposes or to meet a legal obligation.

If the Client wishes to know how Schino Care uses his Personal Data, request to rectify them or oppose their processing, the Client can contact Schino Care in writing at the following address:

In this case, the Client must indicate the Personal Data that he/she would like Schino Care to correct, update or delete, by identifying himself/herself precisely with a copy of an identity document (identity card or passport).

Requests for deletion of Personal Data will be subject to the obligations imposed on Schino Care by law, particularly regarding the retention or archiving of documents. Finally, Customers of https://lao-care.com/ may file a complaint with the supervisory authorities, and in particular the CNIL (https://www.cnil.fr/fr/plaintes).

17.4 Non-communication of personal data

Schino Care is prohibited from processing, hosting or transferring the Information collected about its Customers to a country located outside the European Union or recognized as "inadequate" by the European Commission without first informing the customer. However, https://lao-care.com/ remains free to choose its technical and commercial subcontractors on the condition that it presents sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: n° 2016-679).

Schino Care undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorized persons. However, if an incident impacting the integrity or confidentiality of the Customer's Information is brought to the attention of Schino Care , the latter must inform the Customer as soon as possible and communicate the corrective measures taken. Furthermore, Schino Care does not collect any "sensitive data" except, occasionally, health data related to Customers' hair problems, and solely on the basis of the Customer's voluntary participation (no obligation).

The Client's Personal Data may be processed by subcontractors (service providers) of Schino Care, exclusively to achieve the purposes referred to above.

Within the limits of their respective attributions and for the purposes mentioned above, the main persons likely to have access to the data of the Customers of https://lao-care.com/ are mainly the Management of Schino Care and the agents of its customer service.

17.5 Types of data collected

Concerning the Customers of the Site https://lao-care.com/ , Schino Care collects the following data which are essential to the operation of the service, and which will be kept for a maximum period of 9 months after the end of the contractual relationship:
name, first name, postal address, email, telephone number, IP address.

17.6 Incident Notification

Despite our best efforts, no method of transmission over the Internet, or method of electronic storage, is completely secure. Therefore, we cannot guarantee absolute security. If we become aware of a security breach, we will notify affected Customers and take appropriate action. Our incident notification procedures take into account our legal obligations. We are committed to fully informing our customers of all matters relating to the security of their account and providing them with all necessary information.

No personal information of the Client of the site https://lao-care.com/ is published by Schino Care without the knowledge of the Client, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the hypothesis of the acquisition of Schino Care and its rights would allow the transmission of said information to the potential purchaser who would in turn be bound by the same obligation of conservation and modification of the data vis-à-vis the Client of the site https://lao-care.com/ .

Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, Schino Care takes all reasonable measures to protect them against loss, misuse, unauthorized access, disclosure, alteration or destruction.

 

Article 18 - Applicable law

The Customer fully accepts and acknowledges that French law governs these General Terms and Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and Schino Care. Furthermore, the Internet user (or Customer) accepts that in the event of a dispute following a visit or purchase on www.lao-care.com, the French courts shall have jurisdiction.
